Head-Tenant You are a tenant (your name appears on the lease of the premises), you reside on the premises and rent part of the premises to another person as part of a separate written agreement. This person is a tenant. People living in residences usually have their own bedroom and share the rest of the premises. Your rights and obligations depend on your legal status. You can be: Shared tenants are generally covered by the Residential Tenancies Act 2010 and the Residential Tenancies Regulation 2019. This factsheet summarizes some of the most important legal issues for people living in residences in NSW. All tenants share together the same rights and obligations arising from the rental agreement. The distribution of rent is a matter of agreement between tenants, but all tenants are jointly and severally liable for the total amount of rent and all damages suffered by the property. Renting a room in a common property: If you are renting a room in a common house or unit, use either a roommate agreement or a housing rental agreement.
